1. Scope and Contracting Party

These Terms of Use govern the use of the iOS app GarageLog360 (hereinafter "the App").

By downloading, installing, or using the App, you agree to be bound by these Terms of Use.

2. License to Use

Xvision Solutions grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes on your iOS device.

Permitted:

• Installation on your own iOS devices
• Use of all free features
• Synchronization via your user account

Not Permitted:

• Redistribution or resale of the App
• Reverse engineering or decompilation
• Commercial use without written permission
• Removal of copyright notices

3. User Account and Guest Mode

3.1 Guest Mode

You can use the App without registration in Guest Mode. Your data is stored locally and can later be linked to a user account.

3.2 User Account

To synchronize your data across multiple devices, you can create a user account.

You are responsible for:

• Keeping your credentials confidential
• All activities under your account
• Immediately reporting unauthorized access

3.3 Account Deletion

You can delete your account at any time via the App settings. All associated data will be permanently deleted (see also Privacy Policy).

4. Your Data

4.1 Data Ownership

You retain all rights to the data you enter into the App (vehicle information, fuel logs, expenses, etc.).

4.2 Data Processing

By using the synchronization feature, you grant us permission to store and process your data to provide the App's functionality.

4.3 Data Export

You can export your data as a CSV file at any time (PRO feature).

5. In-App Purchases (PRO Version)

5.1 PRO Features

The App offers optional PRO features via In-App Purchase:

• Unlimited vehicles
• Extended statistics (10 years)
• CSV export

5.2 Payment Processing

All purchases are processed exclusively through the Apple App Store and are subject to:

• Apple's Terms of Sale
• Apple's refund policies

5.3 Subscriptions and Pricing

PRO features are available as subscription or lifetime purchase:

• Monthly: CHF 4.00 (auto-renewal)
• Annual: CHF 36.00 (auto-renewal, 25% savings)
• Lifetime: CHF 89.00 (one-time purchase, unlimited access)

Cancellation: Subscriptions can be canceled at any time via iOS Settings. The subscription runs until the end of the paid period.

6. Acceptable Use

You agree NOT to use the App for:

• Illegal purposes or violations of applicable law
• Reverse engineering, decompilation, or disassembly
• Interference with the App's functionality or servers
• Uploading malicious code or malware
• Automated data extraction (scraping)
• Spam or abuse of the feedback system

7. Availability and Support

7.1 Availability

We strive to keep the App available at all times, but cannot guarantee uninterrupted availability, error-free operation, or data completeness.

8. Warranties and Liability

8.1 Disclaimer of Warranties

The App is provided "AS IS". We do not guarantee that the App will be error-free or uninterrupted.

8.2 Limitation of Liability

To the maximum extent permitted by law, Xvision Solutions is not liable for indirect or consequential damages, data loss, or lost profits.

Exception: Liability for willful misconduct or gross negligence remains unaffected.

9. Changes to Terms of Use

We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

10. Termination and Suspension

You can stop using the App at any time. We may suspend your access with or without notice if you violate these Terms.

11. Governing Law and Jurisdiction

These Terms of Use are governed by Swiss law. The exclusive place of jurisdiction is Lützelflüh, Switzerland.

12. Intellectual Property Rights

The App is protected by copyright and is the property of Xvision Solutions. "GarageLog360" and the App logo are trademarks of Xvision Solutions.
